1) THE LEGAL WARRANTY

With reference to B2B relationships, it is regulated by art. 1490 cc, entitled "Guarantee for defects in the thing sold", according to which "the seller is required to guarantee that the thing sold is free from defects that make it unsuitable for the use for which it is intended or appreciably diminish it value."

In B2C relationships, the regulation is found in art. 129 cdc (Conformity with the contract) according to which "The seller has the obligation to deliver goods to the consumer that comply with the sales contract". In order for the goods to be considered as such it is necessary that:

a) are suitable for the use for which goods of the same type are usually used; b) conform to the description made by the seller and possess the qualities of the goods that the seller presented to the consumer as a sample or model; c) present the usual quality and performance of goods of the same type, which the consumer can reasonably expect, taking into account the nature of the goods and, where appropriate, the public declarations on the specific characteristics of the goods made in this regard by the seller, the manufacturer or his agent or representative, in particular in advertising or on labelling; d) are also suitable for the particular use desired by the consumer and which was brought to the attention of the seller at the time of conclusion of the contract and which the seller also accepted for conclusive facts.

2) CONVENTIONAL WARRANTY

The legal guarantee for defects in the thing sold can be modified with a specific contractual clause so as to increase or decrease the guarantee itself" (Cass. n. 8578/97),

In B2B relationships The art. 1487 cc provides that "The contracting parties can increase or decrease the effects of the guarantee and can also agree that the seller is not subject to any guarantee".
